On September 2013, 9, AEST, Chilcott was driving Morris on Birmingham Road in Mount Evelyn and knocked down Kelly who was walking on the road. The two escaped after the accident, and Kelly's body was eventually found.

Chilcott and Morris from Croydon were charged with two counts of failing to provide rescue after hitting a person and making false statements in an attempt to obstruct justice. The two attended the Melbourne Magistrates' Court this Thursday. They have been released on bail and will be released on May 5. Attend the court again for trial.
