A homeowner recently contacted AAMI, seeking compensation for damages caused by a fire to their property. The incident reportedly occurred in late September 2023. However, in a surprising turn of events, AAMI decided to decline the claim, citing misrepresentation and a breach of duty of utmost good faith.

According to AAMI, the policyholder failed to disclose crucial information about the property’s condition during the policy application process. The insurer argues that had this information been disclosed, they would not have entered into a contract of insurance.

Assessors and investigators noted significant structural issues, including a cracked front porch, stump heaving, rotten weatherboards, and various other defects. A forensic fire investigator could not determine the use of accelerants but suggested arson.

Despite the policyholder’s insistence that the property was in a normal state, AAMI, supported by reports from Intrax Consulting Engineers and Surete Investigation Services, alleges that pre-existing defects and maintenance issues were present for years.

This alarming case is not an isolated incident, as AAMI’s decision raises concerns about the fairness and transparency of insurance practices. Consumer advocates are now urging policyholders to scrutinize their policies, emphasizing the importance of understanding the fine print and potential loopholes.

As the insurance industry faces growing scrutiny, regulators are expected to review practices to ensure that policyholders are not unfairly treated.
